Trial Court Judgment in Complex Real Estate Fraud Case Leading to Multiple Arrests

The Firm successfully represented an innocent property owner who was defrauded by well-known career criminals in a complex real estate fraud scheme. At the conclusion of the civil trial, adverse parties and witnesses were arrested by the Orange County District Attorney’s office for forgery, recording and filing false instruments, preparing false evidence and perjury.

Non-Suit Granted in Bad Faith Jury Trial

The Firm successfully represented a title insurer in a bad faith action arising from the denial of a claim by the title insurer for a missed lien. The insured claimed compensatory damages in excess of $1 million, plus punitive damages. After a three-week jury trial, the trial court granted the insured defendant’s motion for non-suit.

Summary Judgment Victory in Ponzi Scheme Litigation Matter

The Firm successfully represented a mezzanine lender against securities, tort and authority claims by plaintiff investors who were defrauded in a massive Ponzi scheme involving the sale of tenant in common interests in a senior living facility in Northern California, alleging damages in excess of $40 million dollars. After six years of litigation, the Firm obtained summary judgment on all claims alleged against the mezzanine lender.

Favorable Federal Court and State Court Decisions for Investors/Developers of Mixed Use Development Project

A former hotel operator filed state and federal actions in an attempt to assert an interest in real property pursuant to an option agreement.  The Firm represented investors seeking to develop the property into an oceanfront mixed-use project. After the federal court dismissed the federal claims, the state court action was resolved favorably in favor of the investors after the state court expunged the former hotel operator’s lis pendens, following an evidentiary hearing on a motion to expunge lis pendens.

Jury Trial Decision in Favor of Insured Lender

The Firm successfully represented an insured construction lender against the plaintiff’s efforts to set aside the lender’s $6.8 million deed of trust. At trial, the plaintiff sought rescission, quiet title and declaratory relief. After a seven-week jury trial, the court granted the insured lender’s motion for judgment under Code of Civil Procedure section 631.8, and judgment was entered in favor of the insured defendant.

Federal Jury Trial Verdict in Case Involving Fraudulent Real Estate Transaction

The Firm successfully represented a title insurer in a subrogation action to recover damages arising from a fraudulent real estate transaction against a real estate broker for negligence and gold dealer for conversion. After a federal court jury trial, the Firm obtained a seven-figure verdict in favor of the title insurance company.

Trial Court Victory in Favor of High-Profile Actor in Easement Dispute

The Firm successfully represented a property owner, a high-profile actor, in litigation stemming from a neighboring property owner’s attempt to obtain an ingress and egress easement over the insured’s rural property. The complaint alleged theories of easement by implication, easement by necessity and prescriptive easement.  After a two-week court trial, the trial court entered judgment in favor of the property owner.

Jury Verdict and Trial Court Decision in Favor of Commercial Property Owner Establishing Secondary Easement Rights

The Firm represented a commercial property owner in establishing secondary easement rights under a granted easement against a neighboring property owner in a bifurcated trial.  After the trial court quieted the title in favor of the Firm’s client, the jury then awarded substantial damages in connection with related claims for trespass, negligence and nuisance.  The trial court also awarded the client’s attorneys’ fees and costs.

Trial Court Victory In Dispute Regarding Scope Of A Granted Easement

The Firm successfully represented several rural property owner defendants in an action brought by a neighboring land owner to increase the scope of a granted easement, and for damages resulting from her inability to develop the property. After a four week court trial, the Firm obtained a verdict in favor of all defendants, and obtained an ancillary award of damages.

Successful Trial Court Judgment Granting Implied And Equitable Easements

The Firm successfully represented a property owner in a five day court trial establishing an implied easement and an equitable easement to maintain encroachments that had been in existence for over thirty-five years.

Multiple Trial Court Judgments Defeating Implied, Equitable, Prescriptive And Necessity Easement Claims

The Firm successfully represented a private school against two consecutive lawsuits brought by a neighboring property owner attempting to assert nuisance and trespass claims and to establish easement rights over the school’s property. The Firm was successful at trial in defeating both lawsuits.

Trial Court Judgment Confirming Access Easement Created By Partition Judgment

The Firm successfully represented a developer in a quiet title action against an adjoining landowner to confirm an access easement created as the result of a partition judgment. After a one week court trial, the trial court awarded judgment in favor of the developer. The judgment was subsequently affirmed by the Court of Appeal.

The Firm successfully represented a homeowner in a contentious neighbor dispute establishing the boundary between neighboring oceanfront properties after a one week court trial involving complex survey issues and testimony.

Trial Court Victory Defeating Judgment Creditor Claim Against Insured’s Property

The Firm successfully represented a property owner in an action where the plaintiff sought to enforce an eighteen year old judgment against the insured owner’s real property. After a one week court trial, the trial court entered judgment in favor of the insured defendant, concluding that the plaintiff judgment debtor had transferred all of his interest in the subject property prior to obtaining its judgment or recording an abstract of judgment.

After a three week trial, the Firm obtained a judgment in favor the owner of a large retail development shopping project against a tenant alleging tort and contract claims relating to the construction of the project and complex percentage rent provisions in a commercial lease.

Trial Court Victory In Escrow Liability Case

The Firm successfully represented an escrow company at trial against negligence and contract claims brought by property owners in a cash out refinance transaction who were defrauded by their loan broker who created bogus payoff demands and stole loan proceeds.

Summary Judgment Granted In A “Race Notice” Case

The Firm obtained an early victory in favor of a purchaser of commercial property against a lender who failed to perfect its lien interest. The Firm established that the client was first to record its interest against the property and did not have notice of the prior interest. This early victory saved the client substantial money in attorney fees and cost.

Summary Judgment Granted in Favor of Title Insurer and Its Insured Lender

The Firm obtained summary judgment in favor of a title insurer against a private party lender whose loan servicer absconded with loan proceeds in a refinance transaction. In addition, the Firm also secured a summary judgment on behalf of the subsequent lender who complied with a payoff demand before the loan proceeds were converted by the loan servicer. The court found as a matter of law that the title insurer owned no duties and that the subsequent lender fully complied with the payoff demand.

Favorable Trial Court Judgment Defeating Tort Claims Against Developer For Flood Damage

The Firm successfully represented a developer in lawsuit brought by homeowner alleging several tort claims stemming from substantial flood damage. After a multi-week court trial, the Firm obtained judgment in favor of the developer on all causes of action.

Trial Court Victory In Favor Of Oil Operator Terminating Surface Rights

The Firm successfully represented a defendant developer in lawsuit brought by a plaintiff homeowner for rescission based on an alleged failure to disclose airport noise. The Firm successfully brought a motion for judgment pursuant to Code of Civil Procedure section 631.8 and judgment was entered in the developer’s favor. The judgment was affirmed on appeal.

Jury Verdict Obtained In Complex Partnership Dispute

The Firm successfully represented the plaintiff in a complex partnership dispute between the owners of a successful start-up company. After a three-week jury trial, The Firm obtained a seven figure-verdict in favor of the plaintiff on claims for breach of contract and fraud.

Jury Verdict In Commission Claim Brought By Sales Executive

The Firm successfully represented a sales executive in a claim for lost commissions against a former employer involving complex accounting issues. The Firm also represented the sales executive’s current employer against trade secret claims. After a one week jury trial, jury awarded the sales executive substantial damages on all causes of action. The claims against the current employer were dismissed.

Sexual Harassment Claims Against Employer Settled

The Firm successfully represented an employer against claims brought by a former employee alleging sexual harassment claims. After the employee filed an action in superior court, the Firm had the matter transferred to arbitration where the claims were strategically litigated which lead to a quick settlement.

Represented Employer In Defeating Employee’s Disability Discrimination Claims

The Firm successfully represented an employer against disability discrimination claims brought by a former employee. After several depositions were taken, the claims were dismissed.

Arbitration Award In Favor of Employer Defeating Employee’s Claims Of Sexual Orientation Discrimination

Published Decision Clarifying Important Rule Of Lien Priority

The Firm successfully represented an insured lender in a priority action involving two deeds of trust recorded at the same time against the same property. After the trial court granted summary judgment in favor of the insured lender, the Court of Appeal, in a published opinion, affirmed and concluded that under Government Code section 1170, both deeds of trust were deemed to have been recorded simultaneously and had equal priority. First Bank v. East West Bank, et. al.,199 Cal.App.4th 1309 (2011)

Published Opinion Clarifying Requirements For Good Faith Defense To Fraudulent Transfer

The Firm was hired as appellate counsel to represent an insured lender in a case where the plaintiff challenged the lender’s reverse mortgage lien as a fraudulent transfer. The Court of Appeal affirmed the judgment in favor of the lender and clarified the requirements for a good faith defense. Nautilus, Inc. v. Yang, 7 Cal. App. 5th 1318 (2017).

Reversal Of Multi-Million Dollar Jury Verdict

After an unsuccessful trial court result, the Firm was hired to bring an appeal. The Firm successfully represented individual defendants and a company in an appeal from an adverse jury verdict in excess of $16 million in a trade secret and breach of fiduciary case brought by a manufacturing company against former officers and directors who had left the manufacturer and started a competing company. The Firm obtained a reversal of the damage award on appeal and negotiated a nominal settlement in favor of the defendants after remand of the case to the trial court.

Reversal Of Judgment Against Homeowner In Writ Of Mandate Action

The Firm was retained appellate counsel after an unsuccessful result at trial by another law firm. On appeal, the Firm successfully represented a homeowner in a writ of mandate action against his homeowner’s association in which the homeowner challenged a regulation that had a substantial adverse effect on his property. The Firm obtained a complete reversal of the trial court judgment against the homeowner, obtained a new judgment in favor of the homeowner invalidating the regulation, and obtained an award of the homeowner’s attorney’s fees against the homeowner’s association.

Reversal Of Judgment Against Insured Lender Invalidating Its Deed Of Trust

The Firm obtained a reversal of the trial court’s decision invalidating the insured lender’s deed of trust. The Court of Appeal found that the insured lender’s deed of trust was a valid lien, and remanded the case to the trial court to address unresolved defenses asserted by the borrower.

Reversal Of Trial Court Order Dismissing Case Against Foreign Corporation For Lack Of Personal Jurisdiction

The Firm represented on oil and gas service company in an action for breach of contract against an American oil and gas company and its British parent company. The trial order dismissed the case against the parent company for lack of personal jurisdiction, citing a lack of minimum contacts with the California forum. The Court of Appeal reversed the trial court and ordered the British company to appear and defend the lawsuit. The Firm subsequently obtained a favorable settlement for the client.

Affirmed Judgement Quieting Title To Easement Created By Partition Judgment

The Firm successfully represented a developer in a quiet title action against an adjoining landowner to confirm an access easement created as the result of a partition judgment. After a one week court trial, the trial court awarded judgment in favor of the developer. The judgment was subsequently affirmed by the Court of Appeal.

Affirmed Judgment In Favor Of Developer in In Action For Breach Of Contract And Fraud

The Firm represented a developer who was sued by a prospective homebuyer for breach of contract, fraud and other tort claims. The Firm obtained a dismissal of the case from the trial court after the developer’s demurrer was sustained without leave to amend. The judgment was affirmed by the Court of Appeal.
