Emily M. Marsh, Associate


Ms. Emily M. Marsh is a litigation associate with an excellent reputation for representing clients in business, real estate and employment litigation matters. She regularly represents clients in all phases of litigation, including client meetings, preparing all pleadings, developing a strategic discovery plan, taking and defending depositions, working effectively with expert witnesses, successfully settling cases at settlement conferences and mediations and handling all aspects of pretrial preparation.  Ms. Marsh’s targeted approach has enabled her clients to achieve their litigation objectives in a cost-effective manner.  She is also responsible for the Firm’s social media presence and contributes to its marketing efforts.

Ms. Marsh’s business and real estate litigation experience includes representing title insurance companies and their insureds in escrow liability matters, fraud and forgery claims, easement and encroachment disputes and bad faith claims.  Ms. Marsh represents many title insurers including Doma Title Insurance, Inc., North American Title Insurance Company, First American Title Insurance Company and Fidelity National Title Insurance Company. In addition, she also handles contract disputes, property-casualty matters, financial elder abuse and partnership liability matters. Ms. Marsh also has a wide range of experience in handling complex employment law matters involving issues of sexual and gender harassment, disability discrimination, race and national origin discrimination and wage and hour claims.

Ms. Marsh obtained a Bachelor of Arts in dance and public relations from Hofstra University and her Juris Doctor degree from Chapman University Dale. E. Fowler School of Law. In addition to her Juris Doctor, Ms. Marsh earned certificates in business and entertainment law. Ms. Marsh is admitted to practice in the United States District Court for the Central, Southern, Northern and Eastern Districts of California. She is also a member of the Association of Business Trial Lawyers and the Orange County Bar Association.

Representative Matters

Ms. Marsh was responsible for managing a discovery plan in a complex bad faith case involving the nondisclosure of easements impacting the development potential for a rural property.

Ms. Marsh was instrumental in developing a settlement strategy for a complex real estate litigation matter involving fraud, forgeries and equitable estoppel principals.

Ms. Marsh served as lead counsel on business litigation matter involving the breach of a commercial contract.  She successfully navigated a cost-effective resolution with minimal expenditure on attorneys’ fees.

Ms. Marsh represented a plaintiff employee asserting racial discrimination claims against his former employer, securing a significant settlement and allowing the employee to transition to another job.
